1099 Forms for Landlords: What You Send and What You Receive
Forms 1099-NEC and 1099-MISC are filed only for payments made in the course of a trade or business. When they apply, the threshold is $600 for payments made in 2025 and $2,000 for payments made in 2026, after the 2025 federal law (OBBBA § 70433) amended IRC § 6041(a). On the receiving side, a property manager must report the rent it pays over to you on Form 1099-MISC, and a payment app or online marketplace must send Form 1099-K only above $20,000 and 200 transactions.
The short version
- 1099-NEC and 1099-MISC reporting applies only to payments made in the course of your trade or business. Personal payments are not reportable.
- No IRS source says whether an individual landlord is in a trade or business for 1099 purposes. Schedule E asks the question on Lines A and B; decide it with a tax professional.
- Thresholds: $600 for payments made in 2025, $2,000 for payments made in 2026, and $2,000 adjusted for inflation from 2027.
- Form 1099-NEC is due January 31. Form 1099-MISC is due February 28 on paper or March 31 electronically.
- A property manager must use Form 1099-MISC to report rent it pays over to the owner.
- Form 1099-K is required only when payments exceed $20,000 and the number of transactions exceeds 200, but you must report all rental income either way.

The trade-or-business test
The IRS instructions for Forms 1099-MISC and 1099-NEC (Rev. 12/2026) say: "Report on Form 1099-MISC or Form 1099-NEC only when payments are made in the course of your trade or business. Personal payments are not reportable. You are engaged in a trade or business if you operate for gain or profit." The IRS page "Am I required to file a Form 1099 or other information return?" lists "You are not engaged in a trade or business" as one reason no return is required.
No IRS page addresses individual landlords directly. Congress once added a specific rule for rental property expense payments, § 6041(h), in 2010, and repealed it in 2011. So there is no blanket rule either way: whether you must file depends on whether your rental activity is a trade or business.
The 2025 Schedule E puts the question in front of you:
- Line A: "Did you make any payments in 2025 that would require you to file Form(s) 1099?"
- Line B: "If 'Yes,' did you or will you file required Form(s) 1099?"
Thresholds by payment year
| Payments made in | Form 1099-NEC (nonemployee services) | Form 1099-MISC box 1 (rents) |
|---|---|---|
| 2025 (filed early 2026) | at least $600 | $600 or more |
| 2026 (filed early 2027) | at least $2,000 | $2,000 or more |
| 2027 and later | $2,000 adjusted for inflation | same |
The IRS puts it plainly: "For payments made before 2026, the reporting threshold is $600. For payments made in 2026, the reporting threshold is $2,000." The 2027 inflation-adjusted amount had not been published as of October 19, 2026.
Not every box moved. The 12/2026 instructions keep "At least $600 in gross proceeds paid to an attorney (box 10)," and royalties stay at $10. The IRS FAQ also lists payments to incorporated businesses (other than medical or legal payments) among those that generally need no form.
Deadlines and e-filing
Per the 12/2026 instructions:
- Form 1099-NEC: due January 31, on paper or electronically.
- Form 1099-MISC: due February 28 on paper, or March 31 if filed electronically.
- If a due date falls on a weekend or holiday, it moves to the next business day.
- If you file 10 or more information returns in total, you must file them electronically (for returns filed on or after January 1, 2024).
Collecting a Form W-9
For a U.S. payee, "the IRS suggests that you request the recipient complete Form W-9, Request for Taxpayer Identification Number and Certification." A penalty may apply for an incorrect or missing taxpayer identification number, and backup withholding can apply when a payee does not provide one. A practical habit is to ask each vendor for a W-9 before the first payment, whatever you later decide about filing.
The forms you might receive
Form 1099-MISC from your property manager
A tenant who pays rent to a real estate agent or property manager does not have to report it. But "the real estate agent or property manager must use Form 1099-MISC to report the rent paid over to the property owner." This appears in Box 1 of the instructions, citing Treas. Reg. 1.6041-3(d) and 1.6041-1(e)(5). The threshold follows the table above: $600 for 2025 payments and $2,000 for 2026 payments. On the 2025 Schedule E, rents go on line 3 and management fees on line 11; ask your tax professional how to match the form to your owner statements.
Form 1099-K from payment apps and marketplaces
Under § 6050W(e), as amended by OBBBA § 70432, a third party settlement organization must report only if payments to you "exceed $20,000" and "the aggregate number of such transactions exceeds 200." The change applies as if included in the 2021 American Rescue Plan Act, so the $600 threshold set in 2021 is treated as never having taken effect.
The IRS adds two points: an app "may send you a Form 1099-K with lower amounts," and "No matter the amount of reported payments ... you must report all income on your tax return." The IRS lists getting repaid by a roommate for rent among personal payments that are not for goods or services.
Form 592-B for out-of-state owners
If you live outside California and a manager withholds California tax from your rent, you receive Form 592-B, which the withholding agent must send by January 31 of the following year. See California's 7% withholding on rent.
Records that tie it together
| Document | Who prepares it | What to do with it |
|---|---|---|
| Form W-9 | Each vendor you pay | Keep on file; it supplies the payee's taxpayer ID |
| Form 1099-NEC / 1099-MISC (sent) | You, if the rules apply | Furnish to the payee and file with the IRS by the dates above |
| Form 1099-MISC (received) | Your property manager | Compare box 1 rents with your own rent ledger |
| Form 1099-K (received) | A payment app or marketplace | Match it to your records; report all income whether or not a form arrives |
| Form 592-B (received) | A California withholding agent | Use it to claim withholding on your California return |
This page covers federal forms. California's own information-return rules for 1099 payments are not covered here; ask your tax professional.
What to do next
- Talk with your tax professional about whether your rental activity is a trade or business, so you can answer Schedule E Lines A and B.
- List every vendor you paid during the year, with totals, and note which payment year's threshold applies ($600 for 2025, $2,000 for 2026).
- Request a Form W-9 from each vendor, ideally before the first payment.
- When your manager's Form 1099-MISC arrives, reconcile it against your monthly owner statements. A rental records system makes this faster.
- Calendar January 31 (1099-NEC) and February 28 or March 31 (1099-MISC) if you will file.

Frequently asked questions
Do landlords have to send 1099s to contractors?
There is no blanket rule. Forms 1099-NEC and 1099-MISC are required only for payments made in the course of a trade or business, and no IRS source says whether an individual landlord is in a trade or business for this purpose. Schedule E asks the question on Lines A and B, and a tax professional can help you answer it for your rental.
What is the 1099 threshold for 2026?
For payments made in 2026, the threshold for Forms 1099-NEC and 1099-MISC box 1 rents is $2,000, up from $600 for payments made in 2025. Gross proceeds paid to an attorney in box 10 stay at $600. From 2027 the $2,000 amount is adjusted for inflation, and that figure had not been published as of October 2026.
Why did my property manager send me a Form 1099-MISC?
The IRS requires a real estate agent or property manager to use Form 1099-MISC to report the rent it pays over to the property owner. Compare it with your owner statements, and report your rents and expenses, including management fees, on Schedule E.
Do I report rent that came through a payment app if I got no 1099-K?
Yes. A payment app must send Form 1099-K only when payments exceed $20,000 and transactions exceed 200, but the IRS says that no matter the amount reported, you must report all income on your return. Some apps send a 1099-K for lower amounts anyway.
Do I need a W-9 from vendors I pay?
The IRS suggests requesting Form W-9 from U.S. payees so you have their taxpayer identification number. A penalty may apply for a missing or incorrect number on a required return, and backup withholding can apply when a payee does not provide one. Collecting it up front avoids chasing it in January.
