Yes, you can rent out your San Diego home when you PCS, and military owners get one tax advantage civilians do not: you can suspend the five-year home sale lookback for up to 10 years while on qualified official extended duty (IRC § 121(d)(9)). The trade-offs are local. In the City of San Diego, tenants have just cause protection from the first day, so getting the home back for yourself depends on the lease you sign now. Plan the power of attorney, insurance and California tax steps before your report date.

Key takeaways

  • The § 121(d)(9) election can suspend the five-year test for up to 10 years if your duty station is at least 50 miles away or you live in government quarters under orders, and California conforms.
  • VA loan occupancy is about genuine intent and move-in timing at closing; the VA statute and handbook do not set a minimum number of months you must live there before renting.
  • In the City of San Diego, owner move-in on leases from June 24, 2023 requires the tenant's written agreement or a lease clause, plus two or three months' rent in relocation.
  • Get a power of attorney that fits what your agent will sign, and ask escrow or title before you leave whether they will accept it.
  • PCS out of California makes you a nonresident for tax, but your San Diego rent stays California-source income, and the 7% rent withholding has no military exemption.

Keep, rent or sell: the decision for military owners

The choice is the same as for any owner, with three military twists. You may return to San Diego on later orders. Your sale exclusion window can be paused. And managing from a ship, an overseas post or another state makes local help, such as San Diego property management, more important. Compare rent against carrying costs and weigh the sale timeline in should you rent out or sell your San Diego home.

The home sale exclusion and the military suspension

You can generally exclude up to $250,000 of gain ($500,000 for joint filers) if you owned and lived in the home for two of the five years before the sale (IRC § 121). Under § 121(d)(9), you may elect to suspend the five-year period while you or your spouse is on qualified official extended duty, meaning:

  • a duty station at least 50 miles from the home, or living in government quarters under orders; and
  • active-duty orders for more than 90 days or for an indefinite period.

The suspension cannot extend the five-year period by more than 10 years. Periods on qualified official extended duty, up to 10 years, also do not count as nonqualified use. Depreciation taken while the home is rented is not excludable either way. California conforms to the suspension (FTB Pub 1032, 2025). VA loan occupancy and renting later

The VA occupancy certification is made when you apply and again at closing: you certify that you intend to occupy the home as your residence (38 U.S.C. § 3704(c)). VA's Lenders Handbook defines a "reasonable time" to move in as within 60 days after closing, and says occupancy beyond 12 months "generally cannot be considered reasonable." If you are on active duty and cannot occupy, a spouse, or a dependent child through an attorney-in-fact or guardian, can satisfy the requirement.

What the rules read for this guide do not do is set a minimum number of months you must live there before renting. Occupancy is about genuine intent at closing, so never certify intent you do not have. Two practical points for owners who rent: VA's handbook lets a veteran who moved away and rents the home refinance with an IRRRL based on previous occupancy, and the 2025 VA Partial Claim Program is limited to a borrower's primary residence, so it may not be available on a home you now rent. Details are in VA loan occupancy and renting out your home.

On the mortgage itself, the SCRA's 6% interest cap and foreclosure protections apply only to debts taken on before military service. A loan taken out while already on active duty gets neither.

Powers of attorney before you leave

Someone may need to sign a lease, a repair contract or sale papers while you are away.

  • Military POA. Federal law gives a military power of attorney the same legal effect as one made under state law (10 U.S.C. § 1044b). Installation legal assistance offices prepare POAs for eligible service members at no cost; Military OneSource can point you to one at 800-342-9647.
  • California POA. A POA is legally sufficient if it is dated, signed, and either notarized or signed by two qualified adult witnesses (Probate Code § 4121). A durable POA stays in effect if you become incapacitated (§ 4124).
  • Recording. A POA used to sign deeds or that will be recorded needs a notarized acknowledgment (Gov. Code § 27287). Ask your escrow or title officer before you deploy whether they will accept your POA.
  • Special vs. general. A special POA is limited to a certain transaction, such as the sale of a particular property; some institutions accept a general POA only for basic transactions.

More is in power of attorney for military homeowners. A POA is separate from a management agreement and does not let a friend manage for pay without a broker license.

Getting the home back: San Diego tenant rules

If you may return, the lease you sign now matters more than anything else.

  • City of San Diego: the Tenant Protection Ordinance (SDMC §§ 98.0701 to 98.0710) requires just cause from the start of any tenancy of more than 30 days. For leases entered on or after June 24, 2023, owner move-in works only if the tenant agrees in writing or the lease expressly allows it (SDMC § 98.0704(b)(1)(A)). You or a qualifying relative must move in within 90 days and live there 12 continuous months, and you owe relocation of two months' rent, or three if the tenant is 62 or older or disabled.
  • Exemption: a single-family home or condo not owned by a REIT, a corporation or an LLC with a corporate member can be exempt from the City ordinance and the state rules, but only if the tenant received the exact exemption notices, which must be in the lease for newer tenancies.
  • Chula Vista applies just cause from day one; Imperial Beach and the unincorporated County apply it after 12 months under IBMC ch. 9.90 or state law. If the home is in Coronado, see the Coronado Rental Guide.

Set rent with the current limits in mind. As of October 2026 San Diego County is under a state of emergency after Tropical Storm Rachel, so Penal Code § 396 generally bars rent advertised, offered or charged more than 10% above the pre-emergency amount, including at turnover, through November 14, 2026; check whether it has been extended. The state cap on covered homes is 8.2% for increases effective August 1, 2026 to July 31, 2027.

Tax, insurance and tenants after you PCS

California tax. California-domiciled members who leave on PCS orders become nonresidents for income tax, but California still taxes California-source income, including rent from your San Diego home (FTB Pub 1032). The SCRA rule that shields military pay from a state where you are not domiciled does not cover rental income. If a manager pays you as a nonresident, it must generally withhold 7% once payments exceed $1,500 in a year, and nothing in Pub 1032 exempts service members. See owning a San Diego rental from out of state.

Insurance. Switch to a landlord (dwelling) policy before the tenant moves in. It does not cover the tenant's belongings.

Your tenants. You may rent to anyone who meets your written criteria; military and veteran status are protected in California housing, so never screen on them. If you rent to a service member, the two-month small-landlord deposit exception does not apply, and a service member tenant can end the lease on PCS or deployment orders of 90 days or more under the SCRA (50 U.S.C. § 3955). HOMES.mil, the official DoD listing site, says listings are free. Our guide to renting your home when you relocate covers the move-out steps.

Frequently asked questions

Can I rent out my house with a VA loan when I get PCS orders?

The VA occupancy requirement is about your genuine intent to occupy and move-in timing at closing. The VA statute and Lenders Handbook read for this guide do not set a minimum number of months you must live in the home before renting it. Confirm your situation with your lender, and never certify intent you did not have.

How does the military home sale exclusion work?

Under IRC § 121(d)(9), you can elect to suspend the five-year lookback while you or your spouse is on qualified official extended duty, for up to 10 years. That applies when your duty station is at least 50 miles from the home or you live in government quarters under orders, on orders of more than 90 days. California conforms.

Do I pay California tax on rent if I PCS out of California?

Yes. California-domiciled members who PCS out of the state become nonresidents for income tax, but rent from California property stays California-source income and taxable. A manager paying you rent must generally withhold 7% after the first $1,500 in a year.

Can I evict my tenant to move back into my San Diego home after my tour?

Only on terms the law allows. In the City of San Diego, for leases from June 24, 2023, owner move-in requires the tenant's written agreement or a lease clause allowing it, a 12-month stay by you or a qualifying relative, and relocation of two or three months' rent.
